TRY NEW THINGS Competition: Official Rules and Terms & Conditions (Official Rules)

1. ELIGIBILITY

To be eligible to win the prize you must have registered as a user, stylist or salon on Bangstyle.com or the free app.

This competition (Competition) is being run by DS Laboratories (Promoter). The Promoter, DS Laboratories, does not accept any responsibility for late, lost or misdirected entries or submissions. Upon submission all entries will become the property of the Group and will be freely available for Bangstyle and DS Laboratories to publish/distribute on Social Media, and/or in other mediums (with limitation) as determined by the Group.

The Competition is open to all, excluding any employees or contractors, or their families or partners, of the Group and these people are specifically excluded from being eligible. This Competition is void in any jurisdiction where the holding of a competition such as this is prohibited by law or restricted by law or regulations. By entering the competition, each participant agrees to be bound by these Official Rules and the decisions of the Promoter in the application of these Official Rules and/or the judges, which are final and binding in all respects.

2. DISCLAIMER

The Group and each of its companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for:
a. any late, lost, misrouted, garbled or distorted or damaged transmissions or entries;
b. telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures in connection with this Competition;
c. any Competition disruptions such as injuries, losses or damages caused by events beyond the control of the Group; or
d. any printing or typographical errors in any materials associated with the Competition, for reasons beyond the Group’s control. This limitation may not be enforceable in all jurisdictions and therefore may not apply to all Eligible Participants.

3. COMPETITION PERIOD

The Competition starts on January 13, 2016 at 12:01 AM PST (Pacific Standard Time) (the "Commencement Date"), and ends on January 20, 2016 at 11:59 PST (Pacific Standard Time) (the "Deadline") and the period between these dates will be known as the "Competition Period”).

All entries are to be submitted electronically and any entries posted outside of the Competition Period will not be considered.

4. HOW TO ENTER

Customer entrants:

Upload your hair creation to Bangstyle writing "TRY NEW THINGS" in the title of the image! To be considered for the prize, users must accept the contest terms and conditions.

Entries are unlimited! Customer entrant’s must be aged 18 years or over.

5. JUDGING AND SELECTION OF WINNER

All entries will be judged by Bangstyle and their editorial team. Selection of a winner will be based on a combination of factors when assessing the submission including, but not limited to, originality, creativity, appropriateness and style.

6. COLLECTION OF INFORMATION

Entry into the Competition requires you upload an image to the BANGSTYLE app or to Bangstyle.com.

By entering the Competition, you consent to the Group’s use of your entry, all information submitted by each entrant, as well as your name and biographical information in connection with the Competition as well as for advertising, marketing and publicity purposes in connection with the Competition, in any and all media now or hereinafter invented, throughout the world in perpetuity. You are consenting to your imagery being shared on Social Media sites. Model is not entitled to an additional prize, only the entrant. You are informed that the personal data collected in connection with the Competition will be collected by the Group’s servers and computer systems which are based in the US, and such collection will therefore be subject to applicable US laws, including US privacy laws. You may also withdraw your personal data upon request, however you will be disqualified as an entrant in the Competition if you withdraw your personal data prior to the determination and fulfillment of the prizes.

7. CONDITIONS FOR PRIZE

Prizes cannot be substituted, assigned or redeemed for cash, but the Group reserves the right to substitute any prize (or portion of a prize) with one of equal value should that prize (or portion) become unavailable for any reason. If any winner cannot or does not accept a prize as stated, that prize will be forfeited in its entirety.

There will be a total of 1 prize distributed. All entrants will make available satisfactory evidence of their residency at the request of the Group.

Prize details:

Up to USD$1,000 USD of DS Laboratories products and goods

Without limiting any other rights, the Promoter has the right to, in the Promoter's sole discretion, reject or remove from the Competition any entry that, in the Promoter's sole discretion, violates these Official Rules, any applicable Promoter policy, any applicable laws, or is in any way harmful or objectionable. Promoter also reserves the right to disqualify any entrant or entry at the Promoter 's sole discretion. No correspondence shall be entered into and the decision of the Promoter shall be final.

8. ANNOUNCEMENT OF WINNER

The names of the winners will be posted on the DS Laboratories and Bangstyle Facebook page onJanuary 21, 2016. The winners will also be notified by email before this date. Prize collection details will be disclosed within the email to the winner.

9. COPYRIGHT

Each entrant warrants that any material supplied by them for this competition is free of any legal claim and indemnifies the Group and its subsidiaries against same. DS Laboratories may at its own discretion remove or delete (or both) any material submitted by an entrant at any time.

10. GENERAL

Winners are solely responsible for the payment of any taxes that may arise as a result of acceptance of a prize, and all other expenses or costs relating to a prize not expressly set forth above. Other than as set out in these Official Rules, prizes cannot be transferred or substituted and must be accepted as awarded. No more than one prize will be awarded to any entrant. A prize will be awarded to the entrant irrespective of whether or not the winning submission was developed / created by a group.

These Official Rules and any disputes relating in any way to the Competition shall be governed exclusively by the laws of the State of California, without regarding to principles of conflicts of laws. By participating, each entrant further agrees that:
i. any and all disputes, claims, and causes of action arising out of or in connection with the Competition, or any prizes awarded, shall be resolved individually without resort to any form of class action;
ii. any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Competition, but in no event lawyer’s/attorney’s fees;

*Where national, state or territory laws applicable to the entrant specifically allows that any resident person may enter the Competition in these states or territories, entry is open to all resident individuals. In this case, entrants will need to request a Competition Code from the Group and to produce satisfactory evidence of their residency of the relevant nation, state or territory.
